Reuven Weber, 21, remained in Richardson City Jail on Thursday after being charged with criminally negligent homicide in the death of Roxanne Everett. He also was cited for providing alcohol to a minor.

"I don't believe any intentional harm came to her," said Lee Everett, father of Roxanne, 19. "It was just an accident."

The Dallas County medical examiner's office also ruled that Ms. Everett's death was an accident and determined that she died of blunt force injuries.

Mr. Weber's bail has been set at $7,000.

While the case remains under investigation, Richardson police Lt. Mike Scott said it's not unusual to file criminally negligent homicide charges in accidental deaths. He compared it to a motorist who kills someone by running a red light. The medical examiner may rule that the victim died as a result of an accident, Lt. Scott said, but the motorist may face charges because of negligence in causing the death.

Criminally negligent homicide is a felony carrying a maximum penalty of two years in prison or a $10,000 fine.

Richardson police were called about 2:30 a.m. on Dec. 25 to a house in the 400 block of Lowell Lane, near Arapaho and Custer roads. They determined that Ms. Everett had fallen from the roof of the two-story house, which appraisal records indicate is owned by Ines M. Weber.

Ms. Everett was taken to Parkland Memorial Hospital, where she died of her injuries.

Police declined to comment on why Mr. Weber and Ms. Everett were on the rooftop. Mr. Everett said he believes the two friends were simply looking at the night sky. On Christmas Eve, the planet Mars was unusually bright because its orbit placed it in nearly a straight line with Earth and the sun, according to astronomers.

"Basically they were a couple of young people stargazing on the roof," Mr. Everett said. "When it became cold, they tried to come down. She may have tangled her foot in the blanket they were on."

Mr. Everett said his daughter, a 2006 graduate of Plano West High School, would be buried next to her mother, who died three years ago. In addition to her father, Ms. Everett is survived by two sisters and a brother.

Funeral services will be conducted at 11 a.m. Sunday at Sparkman-Dickey Funeral Home, 17501 N. Dallas Parkway, Dallas.
