Phendy Pamphile, 26, of 546 Pleasant St. in Brockton, was arraigned Aug. 9 in Wareham District Court on one count of manslaughter while operating under the influence, and one count of motor vehicle homicide in connection with a June fatal, head-on crash that killed Wareham's Christopher Elicier.

Pamphile's arraignment was delayed due to injuries he sustained in the collision. He was served a criminal summons while recuperating at Rhode Island Hospital. Pamphile had already retained an attorney who advised him not to speak with police.

Pamphile was traveling the wrong way on Route 495 in Wareham when he crashed head on into the car of Elicier, a 43-year-old father of two from Wareham. Elicier was heading to his shift at Taunton State Hospital when his car was rammed head on by Pamphile on June 16 at 10:30 p.m.

According to a report filed by state police in Wareham District Court, police at the scene "smelled a strong odor of alcoholic beverage emanating from the white Lexus," driven by Pamphile.

A witness stated that Pamphile was at a cook out in Wareham earlier in the evening. The witness stated that he was slurring his words, and several people at the party attempted to take his keys to prevent him from driving.

According to a witness, at one point Pamphile vomited on himself and all over the bathroom, and the witness did not think he was fit to operate a motor vehicle in his condition. A witness also reports that his eyes were "half shut."

The witness states that the homeowner offered Pamphile a couch to sleep on for the night, and then made him a bagel, which he took into the backyard to eat. Shortly thereafter the witness says Pamphile hopped the backyard fence and took off in his car. The witness states that she heard a car "peel out," then observed Pamphile's car driving down the street.

According to the report, the Plymouth County District Attorney's Office has requested that Rhode Island Hospital turn over Pamphile's medical records. Toxicology reports were still pending as of Aug. 9.

He is due back in court on Sept. 27 for a pre-trial hearing. His terms of release include total abstinence from alcohol and drugs, no driving, and he must report to probation twice a week.
