A Norwich man accused of assaulting his 20-month-old daughter, who died a day later, remained jailed Thursday as Chenango County prosecutors continued building a case to bring before a grand jury.

Devan A. Ellsworth, 28, has been charged with a felony count of second-degree assault and a misdemeanor count of endangering the welfare of a child in connection with Sunday's attack, which left Delaney Ellsworth with a subdural hematoma. She died Monday night while hospitalized in Syracuse.

Court records accuse Ellsworth of recklessly injuring Delaney by intentionally striking her on or about the head and face, leaving her with a head injury. It happened shortly after 6 p.m. Sunday at 58 Henry St., in Norwich.

Chenango County District Attorney Joseph McBride said Thursday this case is expected to go before a grand jury in September, to seek an indictment.

"The charges will be upgraded," McBride said.
