A mother accused of hiding her dead baby in a hole behind their State Street apartment has been indicted by a grand jury.
On Wednesday, City Court Judge Mark Caruso informed Heaven Puleski that she had been indicted on Aug. 28 by a county grand jury and that her criminal case had been transferred to county court.
Puleski did not speak during the brief proceeding as she stood next to her court-appointed attorney, Lara Barnett.
Puleski, 38, remained Wednesday at the Schenectady County jail on $20,000 bail.
Assistant District Attorney Christina Tremante-Pelham, who is handling the case but did not appear in court Wednesday, declined to discuss the indictment or if the case was still in the hands of the grand jury.
"The investigation into the cause of death and the circumstances surrounding how he (Rayen) died is still pending, it's still open," said Tremante-Pelham. She said a date has not been set for Puleski to be arraigned in county court.
Puleski was arrested earlier this month on charges of unlawful disposal of a body, tampering with evidence and child endangerment.
Police accuse her of being incapacitated by heroin and unable to care for the baby during his final days. Police have not said when the boy died but court documents say the drug use occurred between July 17, the last day police and relatives say the baby was seen, and July 23.
She is accused in court papers of wrapping the child's body in plastic bags and then hiding it in a hole at 766 State St. where they were living at the time.
Puleski has told authorities she was high on heroin, feel asleep, and somehow ended up on top of Rayen's body, according to several people with knowledge of the ongoing probe, who spoke on condition anonymity because they are not authorized to discuss the matter.
They said Puleski awoke to find her child not breathing and it appears Rayen died about three weeks before law enforcement discovered the body on the evening of Aug. 9.
So far, a pathologist has been unable to say how 4-month-old Rayen Puleski died. More tests are being done on the badly decomposed body.
A Schenectady police spokesman said Wednesday that the autopsy results have not yet been received.

Asked about the sequence of events, both the defense attorney and prosecutor declined comment.
Schenectady County officials have said they are prohibited by law from discussing Puleski's case.
